Is the question of Obama's eligibility nonsense or a fundamental Constitutional question?

A courageous Army officer is being court martialed because he is asking the president to do what every member of the military MUST do -- provide their long form birth certificate and their records: both educational and medical. Lieutenant Colonel Terrence Lakin is a career medical officer and decorated war hero. He has served 18 years in the Army and been deployed on foreign soil six times.

He is being court martialed for disobeying a "lawful" order to report for a second tour of duty in Afghanistan. Officer Lakin loves this country and he will pay a huge price if he loses this case. He will lose his pension, be stripped of all his decorations, be dishonorably discharged, and possibly be imprisoned. Does anyone really believe this patriot is doing it on a whim? No. He believes in the Constitution and wants, no demands, that it be upheld.

Congress investigated the Constitutional eligibility of John McCain who was born in the Panama Canal Zone. They did not investigate the Constitutional eligibility of Barack Obama. Why not? The Democratic National Committee confirmed his eligibility based on .... nothing.


The so-called "birth certificate" from Hawaii is only a certification that Obama was, in fact, born and his birth was registered in that state. According to Officer Lakin, "Until the summer of 2009, the Hawaiian Department of Homelands would not accept this Certification of Live Birth to determine native Hawaiian identity -- the Department insisted upon also reviewing an original birth certificate." Interesting, eh? The change in policy coincided with the eligibility controversy.

So where is the long-form birth certificate that confirms the place of birth and the attending physician? It has never been produced and Obama has spent millions to make sure it never is. He has blocked release of ALL RECORDS THAT WOULD SHOW HIS PLACE OF BIRTH including educational and medical records. Why?

The military judge ruled last month that LTC Lakin has no right to ask for Obama's documents. This kangaroo court reminds me of the treatment of pro-lifers. The courts almost always refuse to allow the "necessity defense" for rescuers who block abortion mills. The "necessity defense" says someone can violate trespassing laws, etc. to protect lives or even property. A fireman, for example, can break down a door to get to a trapped person. Once a court blocks that defense, exploring the motivation of rescuers to save lives, conviction for trespassing is pre-ordained.

The same is true of Terrence Lakin. He did not refuse a "legal" order if the president is in office illegally. But if he is not allowed to pursue the eligibility issue, he has no defense. He is unconstitutionally muzzled and will be convicted by default. That's what his lawyer said in the video below following the judge's ruling that the eligibility issue could not be pursued. What a travesty!



When Lakin goes before the military court in November, it is likely the judge will declare, by judicial fiat, that the order was legal. Then it becomes simply a matter of did Lakin obey or disobey? He will be hammered by the power structure that doesn't give a whit about truth!

I've been been in the defendant's seat for trying to save babies from the butcher's knife, but for me conviction only meant a few days in jail. For LTC Lakin it means the destruction of a career and financial ruin. Who is more deserving of belief in this matter? The master of lies, President Obama, or this heroic officer and medical doctor? I know where I'd put my money!

But the battle is far from over. As LTC Lakin says in a video I previously posted here, "The Constitution matters; the truth matters." Please pray for this courageous defender of our Constitution. He deserves better. To follow his story visit the American Patriot Foundation.

The video below shows LTC Lakin's shameful treatment at the hands of CNN's Anderson Cooper who refuses to address the real question and continually attempts to deflect the subject to extraneous issuues while simply shouting down Lakin's attorney. His bullying behavior is reprehensible, but typical of the drive-by media. That's why the truth is so often suppressed. Folks like Cooper, Matthews, Maher, etc. are only interested in furthering the liberal agenda. If real people like Terrence Lakin get in their way, "Crucify them!"

  1. Here's the oath that military officers must take (from the army website). "I, _____ (SSAN), having been appointed an officer in the Army of the United States, as indicated above in the grade of _____ do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic, that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservations or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to enter; So help me God"

    Note that they are sworn to uphold the Constitution, not the current President. The reason for that is obvious. SHould the president issue orders in violation of the Constitution, the military officer is bound by his/her oath not to obey such order.

    If Obama is not a natural-born citizen, then he has no authority to command the military. This question must be answered. I certainly do hope the new Congress has the wisdom to see that - and to initiate impeachment, as that most likely will be necessary.

  2. You might want to remove your references to the American Patriot Foundation as far as LTC Lakin is concerned.

    Lakin has hired a new law firm to salvage him from the frightful mess he is in.

    Check the safeguardourconstitution.com site -- all remaining references to defending Lakin are in the past tense.

  3. Looks like Lakin has finally wised up and fired Jensen and APF from his legal team, and hired actual professional lawyers who are experts in military law. I suspect he'll be changing his plea to guilty, since there never was any question of that anyways. At least with real lawyers he might be able to beg mercy based on the incompetence of his counsel, and the stupidity of Birthers in general.

    Too bad he had to throw away his career in the process.

  4. As of Sept. 28th Paul Jensen was still speaking as LTC Lakin's attorney. I haven't been able to find anything that indicates things have changed. If you have different information, please post it.

  5. Yes, as of Sept 28th he was, and as of today he is not. One way to see it is by going to www.safeguardourconstitution.com. If you remember, it used to be a fund-raising page for the Lakin defense fund, with the silly animated gif of Lakin appearing behind bars. Now there's no mention of Lakin on the front page; and when you go to "Current Projects," it speaks of him in the past tense: "APF defended LTC Terry Lakin. Lt. Lakin refused to deploy until Barak Obama proves is ellgibility to be president..."

    Oh, and by the way, Mr. Jensen is currently in the news because he's representing the woman opposing David Beckham in some sex-scandal law suits.
