Supreme Court Blocks OSHA mandate; Victory for Workers!




Supreme Court blocks Biden’s business vax mandate, allows jab requirements for gov’t healthcare providers

I'm reading the Supreme Court's decision and it's clearly a victory for workers! It cancels the OSHA mandate which frees about 84.2 million workers (OSHA's estimate) from the mandatory jab. The court's reasoning? OSHA (Occupational Safety and Health Administration) never had that kind of authority which is about "occupational" safety. Mandating broad health regulations is outside their function to protect people "on the job." 

COVID is a general risk, not an "occupational" risk with few exceptions, e.g., those actually working with live viruses. Unlike requiring fire extinguishers, air filters, ear protectors, goggles, etc. you can't leave the toxic jab at the factory when you go home. Besides which, Congress never gave that kind of authority to mandate broad health measures to the Executive Branch of government and specifically to OSHA! 
[The "vaccine" mandate is] a significant encroachment into the lives—and health—of a vast number of employees. “We expect Congress to speak clearly when authorizing an agency to exercise powers of vast economic and political significance.” ... There can be little doubt that OSHA’s mandate qualifies as an exercise of such authority.... The question, then, is whether the Act [1970 establishment of OSHA] plainly authorizes the Secretary’s mandate. It does not. The Act empowers the Secretary to set workplace safety standards, not broad public health measures.... [OSHA] in its half century of existence, has never before adopted a broad public health regulation of this kind—addressing a threat that is untethered, in any causal sense, from the workplace. This “lack of historical precedent,” coupled with the breadth of authority that the Secretary now claims, is a “telling indication” that the mandate extends beyond the agency’s legitimate reach. [You can read the decision for yourself, along with the separate concurring and nonconcurring opinions.] 
Ya think? When did that ever stop a liberal president with a phone and a pen?

The court summarized the Biden administration's goal which was really never about anybody's safety;
The purpose of the rule was to increase vaccination rates at “businesses all across America.” In tandem with other planned regulations, the administration’s goal was to impose “vaccine requirements” on “about 100 million Americans, two-thirds of all workers.” 

Nope! It was never about safety on the job; it was always about expanding forced participation in the global experiment with the unapproved mRNA gene therapy. The Biden rule included draconian fines for companies who failed to comply and ordered firing employees who refused the jab with very narrow exceptions and alternative behaviors like weekly tests and masking.

I'm offering my rosary today in thanksgiving for the Supreme Court's decision on the OSHA mandate. I'll address the concurring opinion of Justices Gorsuch, Alito, and Thomas tomorrow. In the meantime, let us all pray for our poor country!

I was in the ER with a relative two nights ago and while we were sitting in the ER waiting area a man and woman came in and I heard the woman tell the admitting personnel that her husband had just tested positive for covid. The admitting person talked to them for a few minutes, the man was taken back for a blood test, then shortly returned and he and his wife were told to sit down...in the ER waiting area!...with all the sick and injured! They were still sitting there when my relative was FINALLY put in an ER room to be officially seen by a doctor.

    I asked the nurse why there wasn't a special area for covid patients to be quarantined from the rest of the sick people. Here's the answer: When covid first broke out two years ago the hospital had a large tent set up outside for processing covid patients. However the covid patients complained that they were being SEGREGATED!!! They felt that wasn't FAIR and thought that being SEGREGATED indicated they weren't receiving equal care, or care as fast as the other ER patients. (The ER is FAST?)

    I hinted that as a result then the hospital apparently now INTEGRATES covid paitents with other sick people?? The answer was a shrug of the shoulders. On Monday I'm going to call the hospital to see what their covid protocol is these days. If entire countries are locked down because of covid and how dangerous it is, why then does a hospital allow a
    covid-positive patient to sit among the sick and injured in an ER waiting room? Since apparently it's OK for a covid person to be seated with other people, this whole fearmongering thing is POLITICAL in order to stir up FEAR to control people.

    Two people have told me I need to get tested in a few days. Um. NO. Why should I get tested. The hospital didn't make an announcement that any of us needed to get tested because we had been expose to covid.
